Service Description

Trees provide a wide range of ecological benefits and are fantastic for our wellbeing, but also come with hazards which we need to be aware of and sometimes manage. Owners of trees have a legal 'duty of care' to ensure their trees are in a safe condition - especially if they overhang a neighbours' property, a public highway or right of way. Under that 'duty of care', the person or organisation responsible for the tree(s) must take reasonable care to avoid acts or omissions that would likely cause harm. So, if you own a dead tree leaning towards the road that you are aware of, you need to take action. However, it is essential to take a balanced approach that considers both the benefits and risks. Trees generally pose a very low risk of harm when compared to driving a car or riding a bicycle, for example. Tree surveys will allow the tree owner to meet legal obligations such as those under the Occupiers Liability Acts (1957 and 1984) and the Health and Safety at Work Act (1974), as well helping to gain a picture of the tree stock you may have and the general health of them.
